George Floyd Scholarship Only Open To Black Students Is Illegal, Federal Complaint Alleges

North Central University in Minneapolis has offered the "George Floyd Memorial Scholarship" to students since 2020. But not to all students. 

The scholarship is only open to black students. Whites, Hispanics, and Asians shall not apply. 

The website for the scholarship says "It is a four-year, full-tuition scholarship awarded to one student each year based on two community recommendations and a written essay."

Not bad. 

For black students, that is.

However, the scholarship is illegal. It violates the Civil Rights Act.

William Jacobson is a law professor at Cornell Law. He runs the conservative website Legal Insurrection and founded the Equal Protection Project. Jacobson filed a complaint with the U.S. Department of Education’s Office for Civil Rights in Chicago, alleging the scholarship violates Title VI of the Civil Rights Act of 1964, which prohibits schools from discriminating based on race.

"The George Floyd Scholarship eligibility requirements are openly racially discriminatory," Jacobson told The College Fix. "Regardless of the purpose of the racial discrimination, it is wrong and unlawful."

Further, Jacobson called upon North Central University to remedy the students whom the university prohibited from applying for the scholarship – as in every non-black student who attended NCU since 2020.

"NCU needs to come up with a remedial plan to compensate students shut out of the George Floyd Scholarship due to discrimination," claimed Jacobson.

The professor says the scholarship violates Minnesota’s Human Rights Act, in addition to the federal Civil Rights Act.

"Similarly, the [scholarship] defies the civil rights protections of Minnesota’s Human Rights Act, which makes it a criminal offense for an educational institution to limit access to any educational program on the basis of race," reads the complaint.

The George Floyd Memorial Scholarship defines what we call Excused Racism, the hypothesis that coordinated discrimination against certain racial groups helps achieve racial impartiality.

Excused Racism is an escalation of affirmation actions, a phenomenon more easily applied such as during scholarship enrollment. 

However, Excused Racism is still racism. And it is still a violation of civil rights. 

Detractors of such will never defeat Excused Racism in the wars of messaging, as in public perception. It must be fought in court.  As William Jacobson plans to do.

In fact, court is the only way to undo DEI-ized culture in which we live. 

North Central University finds itself in a similar situation as billionaire Mark Cuban. Earlier this year, Cuban admitted he uses "diversity" as a "competitive advantage" when hiring and not hiring job candidates.

A commissioner for the U.S. Equal Employment Opportunity Commission then notified Cuban via X that his hiring method violates Title VII law.

"@mcuban , EEOC Commissioner here. Unfortunately you’re dead wrong on black-letter Title VII law. As a general rule, race/sex can’t even be a "motivating factor"—nor a plus factor, tie-breaker, or tipping point. It’s important employers understand the ground rules here," Andrea R. Lucas commented below Cuban's post.

"Competitive advantage" = a motivating factor.

Racial discrimination is not the answer. No honest American would want to live in a country that disagrees. Americans should not put up with it. This is their country, too.
