Canadian Judge Won't Let Unvaccinated Father Visit His Child

A Canadian judge prohibited an unvaccinated father from visiting his 12-year-old child until he gets the COVID-19 vaccine.

The judge, a man called Sean-Sébastien Vaillancourt, ruled on Dec. 23 that it would not be in the "child’s best interest” to have any contact with his father for the time being. Vaillancourt claims the father is opposed to “health measures in the current epidemiological context."

A law expert told the Le Devoir newspaper this ruling marks the first time a judge in Canada has deprived a parent of visitation rights due to his vaccination status.

The details are alarming. In essence, the father requested an additional day with his child during the holidays. But his ex-wife, the child's mother, opposed. She then told the judge that the father is “anti-vaccine."

So is the man actually “anti-vaccine" or is he just not vaccinated against COVID? The mother didn't specify. Nevertheless, he can no longer see his child.

The 12-year-old child is also vaccinated. However, the judge ruled protection from Omicron, a very mild variant, “seems to be reduced” in Quebec. Got that? The judge says the vaccine isn't working against Omicron, but the father must get the jab to see his child.

The mother adds that part of her concerns is that she has two other children under age five living in the house.

“In these circumstances, it is not in the best interests of any of the three children that can exercise access to at this time,” Vaillancourt ruled.

It's unclear whether the mother had these concerns before her ex-husband tried to see his kid for an extra day around Christmas.

The judge will reconsider the matter in February. But it doesn't look good.
