And Here We Go: Dems To Introduce Bill To Expand Supreme Court

Videos by OutKick

During last year’s presidential election and Senate runoffs, Republicans suggested that, if elected, Democrats would attempt to pack the court. The fear was that if Democrats took control of the Senate and presidency while maintaining a House majority, they would have enough power to pack the court.

Now Democrats are attempting to execute that plan.

According to an article on NBC News, Democrats are pushing to add more justices to the US Supreme Court. On Thursday, they will introducing new legislation that would expand the number of justices from nine to 13.

The bill is being spearheaded by Sen. Ed Markey of Massachusetts in the Senate and Rep. Jerry Nadler of New York, the House Judiciary Committee Chair, in the House. It is also being co-sponsored by Reps. Mondaire Jones of New York and Hank Johnson of Georgia.

Whether the bill is ever passed is another story entirely.

The majorities in both the House and Senate are slim, making such a radical change more difficult to push through. At one time, people thought President Joe Biden would be an obstacle in packing the court, mostly because he said he “wasn’t a fan” of the idea.

He is beginning to come around though, which is concerning.

We’ll have to wait and see how things go once the legislation is introduced on Thursday. Stay tuned for updates on this story.

  1. The GOP needs to get ahead of this and say, “If this action becomes official, we will repeal this legislation on first opportunity and remove any of the additional SCOTUS justices confirmed. It will be a total wash and waste of time, and those justices will effectively end their Federal careers in disgrace.” In the meantime, ALL citizens should be ensuring their states elections are set right for 2022. (I think a lot of this stuff is meant to distract people so election-rigging can continue…)

  2. This seems like a constitutional battle. We have three branches of government for a good reason. Checks and balances on the other, so one doesn’t get outsized control. If a single branch can change the essential structure of another without any sort of massive constitutional amendment undertaking more strenuous than the norm, then that branch can simply override the checks and balance meant for it by the other branches. I’m quite certain That’s not what the original designers intended.

    • The Democrats don’t give a flying fuck what the founders intended. about anything. sunshine Republicans (RINOs) who love liberty when it is easy and a dumbed-down electorate put these Democrats in power, and now the wrecking ball is swinging everywhere. Anyone with half a brain and one eye saw this coming during the run-up to the election.

  3. This is total bs but we can’t sit here and act surprised. The writing has been on the wall, the same way it was when all these states announced mass mail-in voting months beforehand (we knew it would be a shit show).

Is it fair RGB died right before Trump left office? Nah. But the conservatives got lucky and were able to get a majority on the Supreme Court. It’s unfortunate timing that Trump was able to replace 3 justices in 4 years but he did it all within the rules of the game. Now the rules are being changed.

      • Idk.. you may have a point? (I don’t follow politics close enough to know what the judges are ruling on every issue). What I do know is that the Dems fought tooth & nail to prevent the last 2 from being appointed.

Now, the Dems can make the argument that Republicans should follow precedent of letting a president elect decide the new appointment… but.. that’s kind of an unwritten rule that would be ignored by the Dems if they had a senate majority at the time.

But either way.. 9 judges has been the number for over 100 years?? Timing & luck is one thing, changing the rules to override shitty luck is a bridge too far.

  4. I am optimistic that this move will be seen as unacceptable by traditional liberals, who are very different from those on the far left. Hopefully the move will fail, and be just one more example of why there should be a tremendous pendulum swing in House and Senate control in 2022.

  5. I mean we all knew this kind of crap was coming. It’s just a little alarming how fast they’ve been burning the country down (literally and figuratively). It’s all so transparently corrupt we can only pray enough libs see the light soon.

  6. Expect a full propaganda push from CNN on how any opposition to this is racist. The 9 we have now is a vestige of white supremacy.

In a month we will have a 100 CEOs demanding this change to make America more inclusive.

In good news. We don’t have to wait 2 years to begin voting out Democrats for this. There will be congressional vacancies between now and then. If one is in your district make sure you vote.

For the long game. To win the school boards are the key. Right now hardly anyone votes in these or knows anything about the candidates. That is how the teachers union took over all of the boards. They tell the teachers who to vote for and that small number of votes determines the outcome.
